Does a legal separation in the state of Arizona stop liability?
I’ve got a family member who lives in the state of Arizona. This family member’s spouse has a huge problem with alcohol. If this person gets drunk and plows into a carload of people, would my family member be responsible if they have a legal separation on file?
My family member is hoping one day to reconcile?!?
Thanks-
PLEASE- only people familiar with the law respond. Thanks.
P.S. They haven’t filed yet, I’m trying to talk my family member into it.
I’m pretty sure that the title and insurance has been separated into two parties. What I mean is that they have 2 cars, one drives one and is titled and insured for that one, and the other drives the second.
If that family member is on title to the car that the drunk is driving you bet your a**. regardless if you are separated or not.
